Carbon border adjustment mechanism consultation response

AmCham EU submitted a response to the open public consultation for the upcoming proposal for a carbon border adjustment mechanism (CBAM) in the EU. As part of the European Green Deal and Europe's recovery plan, one of the main objectives of the measure is to mitigate carbon leakage and help the EU reach its objective of climate neutrality by 2050. AmCham EU and its member companies have the required expertise to contribute to the policy debate and we welcome opportunities to engage in the discussion on the best possible policies to encourage low emission production and to support a fair and level playing field. Our response details our perspectives on the following: objectives of CBAM; the design of the mechanism; Scope; WTO compatibility; potential exemptions and the calculation of carbon content of products.

Industrial Accelerator Act: keeping Europe competitive and open to investment

The Industrial Accelerator Act will be a key test of whether the EU can strengthen industrial competitiveness while advancing decarbonisation. With significant pressure already weighing on businesses in Europe, from high energy costs and supply chain disruptions to unnecessary red tape and intensifying global competition, getting that balance right matters. If Europe fails to send clear signals that it remains a predictable place to invest, capital will go elsewhere.

AmCham EU supports the objectives of the IAA, but its success will depend on how it is designed. A central question in the debate is how ‘European preference’ should be approached. Strengthening Europe’s economic resilience and security is a legitimate objective. However, an approach that creates uncertainty for companies from partner countries, particularly by leaving key decisions to secondary legislation, risks undermining investment and limiting access to the technologies needed for the transition.

The focus should instead be on providing clarity early and rewarding companies that create real EU-added value through manufacturing, R&D, skills and emissions reductions. Learn more in our full paper.

Priorities for a pro-growth Tax Omnibus

The Tax Omnibus presents a critical opportunity to modernise the EU's tax rules in light of the evolving international framework, notably the implementation of Pillar 2. Many existing directives were designed in response to earlier Base Erosion and Profit Shifting (BEPS) measures and now impose duplicative, fragmented and resource-intensive requirements on businesses. These burdens undermine tax certainty, increase compliance costs and weaken the EU’s attractiveness as an investment destination.
