Radical changes to Europe’s product liability rules

In September 2022, the European Commission published its proposal for a review of the current legislation on product liability to respond to a changing, increasingly digital, economy. The three EU institutions are currently negotiating the proposal which could be finalised in December 2023. The Commission’s original intention appeared modest, but under the proposed Product Liability Directive (PLD), radical new rules would come into play. Several key amendments should be introduced to prevent the unintended consequences that would chill innovation and hamper business in the EU.
